The occupation lasted nearly a year — the plant was converted into a community centre (Altepelmecalli, "the house of the peoples") — before federal and state forces cleared it in February 2022 and the company later resumed operations [TBD-VERIFY: the clearance date and the subsequent status of the plant and its concession]. The largest industrial-extraction question is in fact agro-export. The avocado belt of Michoacán and Jalisco, the berry districts of the Bajío and the Pacific states, Chihuahua's pecans and alfalfa-dairy complex, and Sonora–Sinaloa's vegetable exports together constitute, in the critics' frame, a "virtual water" export machine: water-intensive crops grown in deficit basins and shipped to the US market (§6). Conflicts here are diffuse rather than spectacular — illegal orchard expansion and clandestine ollas (irrigation reservoirs) in Michoacán, well-deepening races in Guanajuato, occasional municipal moratoria — but they implicate the system's core: most of the over-allocation is agricultural, and no government has yet confronted the irrigators' acquired rights at scale.

4.3 The Community and Indigenous Water Defences — the Yaqui Struggle and the Justice-Plan Response

The longest-running indigenous water conflict is the Yaqui struggle in Sonora. The eight Yaqui pueblos hold a 1940 Cárdenas-era presidential decree entitling them to half the flow of the Yaqui River; in practice the river's storage system was developed for the Yaqui Valley irrigation district (the cradle of the Green Revolution) and, from 2010, the PAN state government built the Acueducto Independencia to pump Yaqui-basin water from the El Novillo reservoir to the city of Hermosillo. AMLO made the Yaqui case the centrepiece of his indigenous-justice agenda: the 2020–2021 Plan de Justicia Yaqui comprised a formal state apology delivered by the president at Vícam in September 2021, land restitution, a dedicated Yaqui irrigation district, an aqueduct to supply the pueblos' drinking water, and a presidential decree creating a water reserve for the tribe [TBD-VERIFY: the decreed volumes and the implementation status of the irrigation district and aqueduct as of 2026, both reported delayed and partially executed]. The plan is governance-significant beyond Sonora: it is the first explicit federal attempt to settle a water conflict through recognition and restitution rather than infrastructure alone, and its uneven delivery is the test case for whether the rights-based turn in Mexican water politics can be cashed out administratively. Comparable, smaller-scale defences — the Mazahua women's "army" in the Cutzamala source basins, the Wixárika and Rarámuri territorial cases, urban-periphery struggles over pipas and clandestine networks in the Valley of Mexico — fill out a national map on which, by the count of academic observatories, water conflicts number in the hundreds per year and rising [TBD-VERIFY: conflict-count estimates from the UNAM/Colmex water-conflict observatories].

5. The Policy Responses (2012–2026) — the Human-Right Amendment, the AMLO Moves, and the Sheinbaum Reform

5.1 The 2012 Human-Right Amendment and the Fourteen-Year Legislative Failure

On 8 February 2012, the Diario Oficial published the amendment adding to Article 4 of the Constitution the declaration that "every person has the right to access, disposal and sanitation of water for personal and domestic consumption in a sufficient, healthful, acceptable and affordable manner", and instructing that the law define "the bases, supports and modalities" of that access with citizen participation. The practical consequence of the stalemate ran through the entire crisis decade: a constitution proclaiming a human right administered through a 1992 statute built for volumetric concessions, with courts increasingly filling the gap through amparo jurisprudence ordering specific supply remedies but unable to reform allocation.

5.2 The AMLO-Era Moves (2018–2024) — Rhetoric, Selective Projects, and the Decree Battles

AMLO's water policy was characteristically his: morally framed, project-led, and institutionally light. He inherited and amplified the critique of the concession system — repeatedly declaring that water had been delivered to particulares under the "neoliberal period" and that no new concessions would be granted over communities' objections — but undertook no general reform of the LAN and left the 2012 mandate unfulfilled; CONAGUA's budget continued the long secular decline from its early-2010s peak [TBD-VERIFY: CONAGUA budget trajectory 2014–2024 in real terms]. Three move-families defined the sexenio. First, the decree battles: in June 2018 the outgoing Peña Nieto government had issued ten decrees lifting decades-old vedas across some 300 basins and replacing them with "reserves", presented as guaranteeing environmental and human-consumption flows but attacked by Agua para Todos as opening previously closed basins to new concessions [TBD-VERIFY: the decrees' precise scope and the AMLO government's eventual handling — partial defence, partial reversal]; AMLO's own 2020 decree drive against the fideicomisos swept up water-related trust funds, and his 2022 decree declaring water projects national-security matters shielded flagship works from transparency and amparo delays, drawing the same critique as the broader militarised-delivery pattern (MX-I-02, MX-C-02). Second, the flagship projects: Agua Saludable para La Laguna (a roughly 10-billion-peso surface-water treatment and distribution system to wean the arsenic-poisoned Comarca Lagunera off its aquifer, substantially delivered 2023–2024 [TBD-VERIFY: completion status and delivered coverage]), the El Cuchillo II emergency aqueduct for Monterrey, the Santa María and Picachos dam completions in Sinaloa, and the rehabilitation works attached to the Maya Train and Interoceanic Corridor packages. The fair summary: AMLO nationalised the language of water justice and delivered selected hydraulic works, while leaving the 1992 allocation machine — and its over-allocation — intact for his successor.

5.3 The Sheinbaum Agenda (2024–2026) — the Plan Nacional Hídrico and the Concession Reform

Claudia Sheinbaum arrived with more personal authority on water than any modern Mexican president — a doctorate in energy engineering, an environmental-science career, IPCC authorship, and six years governing Mexico City's water stress (her CDMX record included aquifer-recharge, rainwater-harvesting Cosecha de Lluvia, and the management of the 2023–2024 Cutzamala drawdown) — and she moved the file immediately. In November 2024 the government presented the Plan Nacional Hídrico 2024–2030, organised around four axes [TBD-VERIFY: the plan's exact structure and targets]: (i) irrigation tecnificación — modernising on the order of 200,000+ hectares per year across the major irrigation districts to recover several billion cubic metres of agricultural water for reallocation to human consumption [TBD-VERIFY: the hectare and volume targets]; (ii) strategic projects — a portfolio of dams, aqueducts, treatment plants, and the long-deferred repair programmes for the Cutzamala and the Valley of Mexico network; (iii) the Acuerdo Nacional por el Derecho Humano al Agua — a negotiated compact under which large agricultural and industrial concession-holders voluntarily returned unused or excess volumes to the nation, with early announcements claiming billions of cubic metres recovered [TBD-VERIFY: the volumes announced and independently verified]; and (iv) river restoration — the Lerma-Santiago, Atoyac, and Tula basins as flagship clean-ups.

The structural centrepiece is the concession reform. In late 2025 the government sent to Congress the initiative for a new Ley General de Aguas — finally discharging the 2012 mandate — paired with reforms to the LAN [TBD-VERIFY: the initiative's date and architecture]. Its reported core provisions: ending the private transmission of concessions (water rights no longer transferable between private parties; on a concession's expiry, non-use, or the holder's exit, the volume reverts to the nation for reallocation under public criteria), prioritising human consumption in reallocation, hardening sanctions on clandestine extraction and the huachicoleo de agua, regularising smallholder and ejidal irrigation titles, and digitalising/auditing the REPDA against the long-documented gap between paper rights and actual extraction [TBD-VERIFY: each provision against the enacted text]. The initiative provoked the predictable counter-mobilisation: agricultural organisations and northern irrigators — the La Boquilla coalition's heirs — mounted highway blockades and negotiations in late 2025, asserting that reversion-on-expiry and transfer prohibition expropriated rights their members had held (and traded) for three decades, and extracting amendments protecting agricultural-use flexibility and inheritance transmission [TBD-VERIFY: the protest sequence, the concessions made, and the final passage status — reported approved in the Chamber of Deputies in late 2025 with Senate action pending or completed by early 2026]. Wherever the text settled, the political fact is notable: the first frontal legislative assault on the 1992 concession architecture in thirty-three years, undertaken by a Morena supermajority (MX-D-06) with the institutional capacity to pass it — and the question of whether CONAGUA, chronically underfunded and now charged with reviewing tens of thousands of titles, can administer what the law decrees.

5.4 The Infrastructure Ledger — Leakage, Treatment, Reuse, and Desalination

Beneath allocation lies an unglamorous physical deficit. Distribution losses in Mexican cities are estimated around 40 per cent of supplied volume on average [TBD-VERIFY: the canonical national non-revenue-water estimate], the product of aged networks, subsidence-induced breakage (acute in Mexico City), and unmetered or clandestine connections; recovering even a fraction would exceed the yield of most proposed new sources. Wastewater treatment covers on the order of 55–65 per cent of collected municipal flows [TBD-VERIFY: current treatment coverage], many plants operate below design standards, and reuse — the Israeli/Singaporean frontier (§7) — remains a small fraction of treated volume, concentrated in industrial self-supply and the centuries-old (and sanitarily fraught) irrigation of the Mezquital valley with the capital's raw and now Atotonilco-treated sewage [TBD-VERIFY: the Atotonilco plant's operating status — built as one of the world's largest treatment plants, chronically under-utilised]. Tariffs and finance are the binding constraint: most organismos operadores price water below cost, depend on state and federal transfers, and cannot finance renewal — a politically locked equilibrium, since tariff increases are municipally suicidal and the human-right framing is routinely (if incorrectly) read as requiring near-free water. Desalination remains marginal — operating plants in Baja California Sur and industrial projects in Sonora, with the large Rosarito plant for Tijuana repeatedly stalled [TBD-VERIFY: the Rosarito project's status] — constrained by energy cost, brine externalities, and the inland location of the worst deficits. The ledger's summary judgement, common to every serious diagnostic from the OECD's 2013 Making Water Reform Happen in Mexico onward: Mexico does not primarily lack water or engineering; it lacks the pricing, maintenance finance, and utility governance to keep what it has.

6. Water and the Growth Model — Nearshoring, Agro-Export Accounting, and the Urban Inequality of Supply

6.1 The Nearshoring Collision

The nearshoring thesis — that USMCA preference, China-decoupling, and the post-pandemic re-regionalisation of supply chains would make northern Mexico the manufacturing annex of North America (the thesis and its 2025–2026 stress-testing are documented at MX-D-06 and MX-O-01 §5) — was formulated with almost no water arithmetic attached. The collision is geographic by construction: the states recruiting the investment (Nuevo León, Chihuahua, Coahuila, Baja California, the Bajío) are precisely the over-allocated arc of §3, and industrial recruitment is led by state governors whose incentive is to promise inputs first and account for them later.

Monterrey is the test case. Governor Samuel García's Nuevo León landed the signature prize of the boom — Tesla's announced gigafactory at Santa Catarina, unveiled in March 2023, barely six months after the city's taps had run hours-a-day — and met the obvious objection with commitments that the plant would rely on recycled and treated water rather than new freshwater concessions [TBD-VERIFY: the specific water commitments attached to the Tesla permits]. The project's subsequent suspension (Musk's 2024 postponement amid US-election and tariff uncertainty, unresolved through 2025–2026 [TBD-VERIFY: project status as of mid-2026]) means the water commitments were never tested at scale, but the episode fixed the template for every subsequent siting debate: industrial water use in Nuevo León is small relative to agriculture (statewide, industry holds a single-digit-to-low-teens share of concessioned volume [TBD-VERIFY: sectoral shares]), yet industrial visibility is total, and the politics of a thirsty city watching new factories arrive does not run on sectoral percentages. The state's answer — the post-2022 portfolio of El Cuchillo II, the Libertad dam, and wastewater-reuse contracting for industry — amounts to a wager that supply augmentation can outrun recruitment.

Data centres and semiconductors sharpen the collision because their water (and power) demands are continuous and their employment thin. Querétaro — marketed as Mexico's data-centre capital, hosting cloud-region investments by the hyperscalers — sits in a semi-arid basin with declining aquifers, and its build-out has generated the country's first explicit data-centre water debates [TBD-VERIFY: specific Querétaro siting controversies and any disclosed water-consumption figures]; comparable questions attach to the semiconductor-packaging and electronics investments courted under the CHIPS-era "friendshoring" framework in the northern states [TBD-VERIFY: specific semiconductor siting episodes with water dimensions]. The governance gap is structural: siting decisions are made by federal investment promotion and state governments, water accounting by CONAGUA's availability publications (often outdated), and no binding mechanism forces the former to respect the latter. The Sheinbaum water reform's reallocation-priority rules (§5.3) are the first instrument that could, in principle, discipline industrial siting against basin balances; whether it will be applied against flagship investments the same government is recruiting is among the document's forward questions.

6.2 The Agro-Export Model's Water Accounting

Agriculture holds roughly 76 per cent of national consumptive water use [TBD-VERIFY: the canonical CONAGUA figure, usually cited at 76 per cent against ~14–15 per cent public urban supply and ~5 per cent each for industry and thermoelectric], which makes every urban and industrial conflict, in volumetric terms, a skirmish at the margin of the agricultural allocation. The accounting critique — developed by Mexican academics and international observers under the "virtual water" rubric — runs as follows: the post-NAFTA reorientation of Mexican agriculture toward high-value export horticulture (avocados, berries, tomatoes, peppers, citrus, table grapes, pecans, plus beer and tequila as processed water exports) means Mexico ships embedded water from deficit basins to the US consumer; the export boom's private returns are real (agri-food exports passed US$50 billion in the mid-2020s [TBD-VERIFY: the export figure]), but the water is priced at essentially zero — agricultural concession-holders pay no volumetric federal fee for irrigation water [TBD-VERIFY: the current derechos schedule's agricultural exemption] and electricity for pumping was long subsidised under Tariff 9, encouraging overdraft. The counter-case is also real: export horticulture is far more productive per cubic metre than the grain and forage it partially displaced; the problem on this reading is not exporting water-intensive crops but failing to price and cap extraction — the policy failure of §2, not the trade pattern of §6. The synthesis most analysts land on: Mexico's water crisis cannot be solved anywhere but in agriculture — through tecnificación, crop conversion, measured wells, and volumetric pricing — and no government before 2024 was willing to spend political capital there, because the agricultural water franchise is defended by exactly the coalition that seized La Boquilla.

6.3 The Urban-Inequality Dimension — the Pipas Economy and the Intermittency Map

Within Mexican cities, scarcity is distributed by class and cartography. The wealthy west of Mexico City enjoys near-continuous supply; the eastern and peripheral boroughs — Iztapalapa above all, with nearly two million residents — have lived for decades under tandeo (scheduled rotation), low pressure, and water whose quality residents distrust, compensated by the pipas economy: fleets of tanker trucks, some municipal and free, many private and dear, delivering water at multiples of the piped tariff to precisely the households least able to pay [TBD-VERIFY: representative pipa price multiples and the share of CDMX households relying on non-piped supply]. The pattern generalises: across urban Mexico, intermittent supply affects a large share of nominally "covered" households — coverage statistics count connections, not continuity [TBD-VERIFY: national intermittency estimates] — and the coping economy (rooftop tinacos, cisterns, bottled water for drinking) transfers the system's failures onto household budgets. Mexico is the world's highest per-capita consumer of bottled water [TBD-VERIFY: the standard claim and figure], a market built on rational distrust of the tap and itself a political economy with a stake in the status quo. The huachicoleo de agua — clandestine taps, stolen pipas, and criminal intermediation of scarce supply, with documented cartel participation in some metropolitan peripheries [TBD-VERIFY: the documented cases of organised-crime water intermediation in Ecatepec and elsewhere] — closes the circle: where the state does not deliver the constitutional right, an illegal market does, at extortionate prices. The equity reading of the whole system is therefore stark: the formal allocation machine delivers near-free water to agriculture and reliable water to the affluent, while the constitutional rights-holders of 2012 buy theirs by the drum.

7. Comparative and Forward Perspective — Mexico in the Water-Governance Literature and the 2030s Questions

In the comparative water-governance literature, Mexico functions as the canonical concession-overshoot case: a system that created formally secure, registered, partially tradable use-rights — the institutional design the 1990s consensus prescribed — and then issued them beyond availability while never building the measurement, enforcement, and pricing apparatus the design presupposed. The OECD's Mexico water studies, the World Bank's successive diagnostics, and the Mexican academic literature converge on the diagnosis even where they diverge on remedies [TBD-VERIFY: specific flagship-report citations]. The instructive contrasts frame the Sheinbaum reform:

Chile is the neighbour experiment at the market extreme. The 1981 Water Code, the Pinochet-era apotheosis of tradable private water rights, separated water from land, granted perpetual rights free of charge, and made them fully marketable — producing both the efficiency gains its defenders cite and the concentration, speculation, and dry-basin scandals (Petorca's avocados) that made agua a central grievance of the 2019 estallido and a headline issue in both failed constitutional drafts of 2022–2023 (the Chilean sequence is documented at CL-K-05 in the Chile corpus). Chile's 2022 Water Code reform — time-limiting new rights, prioritising human consumption, strengthening sustainability conditions — moved the market model toward the administrative; Mexico's 2025 reform moves the administrative model away from the quasi-market. The two countries are converging from opposite ends on the same insight: neither pure markets nor pure paper administration governs scarcity without measurement, caps, and enforceable priority for human and ecological needs.

Israel and Singapore supply the reuse-and-pricing pole that Mexican policy rhetoric regularly invokes. Israel treats and reuses on the order of 85–90 per cent of its wastewater (overwhelmingly for agriculture), prices water at full cost through a national utility, meters universally, and added large-scale desalination — a package built on small territory, centralised governance, and decades of consistent investment. Singapore's NEWater and four-taps strategy adds the demonstration that recycled water can be politically normalised. The applicability limits are obvious — Mexico's federalism, its 2,500 fragmented utilities, its near-free agricultural water, and its fiscal posture are the inverse of both models — but the direction of fit is not disputed in the technical community: every credible Mexican pathway runs through some Israeli-style combination of universal measurement, cost-covering tariffs with targeted subsidies (the human-right amendment requires affordable, not free), and treated-water reuse at scale, with desalination as a coastal supplement. The political economy, not the engineering, is the constraint.

The 2030s questions can be stated with unusual precision for a policy domain, because the arithmetic is public:

First, the 1944 treaty. The Conchos basin under climate projections cannot reliably yield Mexico's cycle obligations; the 2020 and 2025 crises will recur on a roughly five-year political clock, each under whatever bilateral weather then prevails (MX-E-02; MX-F-01). The options space — supplementary IBWC minutes codifying drought-sharing (on the model of the Colorado's Minutes 319/323, which manage the US delivery side), physical investments in Conchos efficiency credited against deliveries, or a politically explosive renegotiation — will likely be forced within the decade, plausibly entangled with the USMCA's own 2026-and-after review politics [TBD-VERIFY: any 2026 movement toward treaty minutes on the Rio Grande side].

Second, the aquifer deadline. Over-exploited aquifers are not a steady-state problem: depletion is cumulative, quality degradation (arsenic, fluoride, salinity) compounds it, and individual basins — La Laguna, Calera, the Bajío hotspots, the Valley of Mexico itself — face horizon dates within decades at current extraction [TBD-VERIFY: representative depletion-horizon estimates]. The Sheinbaum reform's reversion-and-reallocation machinery is the first legal instrument adequate to caps; whether CONAGUA acquires the metering, personnel, and political cover to apply it against the agricultural franchise is the implementation question on which the decade turns.

Third, whether water disciplines the growth model. The corpus's megatrends document (MX-O-01) poses the 2030s as the decade in which Mexico's nearshoring opportunity meets its institutional constraints; this document specifies the physical version. If allocation reform, agricultural tecnificación, urban-loss recovery, and reuse investment proceed on something like the Plan Nacional Hídrico schedule, water remains a manageable cost of the northern model. If they stall — in CONAGUA's capacity, in the irrigators' blockades, in municipal tariff politics — then the 2022 Monterrey pattern generalises: episodic urban emergencies, investment vetoes by referendum and protest, hardening conflict between cities, farmers, factories, and the treaty, and the quiet redirection of capital that Constellation's Veracruz brewery prefigured. Mexico would then have run the full arc of the 1992 settlement: a paper-rights system born of the reform era, overdrawn for thirty years, and finally disciplined not by law but by hydrology.

8. Conclusion

Mexican water governance between 1992 and 2026 traces a single arc: an allocation architecture built in the reform optimism of the Salinas years — national property, administrative concessions, registered and quasi-tradable rights, devolved irrigation, municipal utilities — that was overdrawn almost from its founding and never acquired the measurement, pricing, or enforcement to live within hydrological means. For two decades the gap between paper and water was absorbed invisibly, by falling aquifers and degraded rivers. In the 2020s it stopped being invisible: a farmer shot dead at a dam Mexico had pledged to a treaty it could no longer comfortably honour; the country's richest city queueing for tanker trucks; the capital's lifeline reservoirs flirting with "day zero"; corporate plants cancelled by plebiscite and occupied by the communities around them. Water moved from the technical annex of Mexican governance to its centre.

The institutional response has been characteristically uneven. The 2012 constitution promised a human right that fourteen years of legislatures declined to implement. The AMLO sexenio supplied the moral vocabulary and selected works while leaving the machine untouched. The Sheinbaum government — uniquely credentialed for the file — has mounted the first structural assault on the 1992 settlement: a national water plan, a negotiated return of concessioned volumes, and a legislative reform extinguishing the private market in water rights [TBD-VERIFY: final enacted form]. Its fate now rests on the oldest constraint in Mexican public administration: whether a chronically under-resourced agency can execute against the country's best-organised acquired interests — the agricultural concession-holders who hold three-quarters of the water and have already shown, at La Boquilla, that they will physically defend it.

The forward stakes exceed the sector. The 1944 treaty binds water to the US relationship and now to the tariff-coercion repertoire of the Trump-2 era; the aquifer arithmetic sets physical deadlines beneath the agro-export model; and the nearshoring wager — the central economic bet of the Sheinbaum sexenio — is being placed in the basins least able to supply it. Whether Mexico's growth model disciplines its water use, or its water disciplines the growth model, is among the genuinely open questions of the 2030s, and this document's standing brief is to track which way it resolves.
