3. The 1991 General Mining Law and the Privatisation Wave

The 1991 General Mining Law was drafted within the broader Fujimori-era structural-adjustment programme described in PE-G-01. Its drafters — economy minister Carlos Boloña, mining-sector advisors including Pedro Sánchez Gamarra, and the Comisión de Reforma Estructural — operated on the premise that Peru's mining sector, dominated since the Velasco-era nationalisations by Centromin, Minero Perú, and Hierro Perú, had become a fiscal drag and a technology backwater. The law's animating logic was that Peruvian subsoil endowments were genuinely world-class but had been under-exploited because of legal-institutional barriers to international capital. Removing those barriers would, the drafters argued, mobilise the investment necessary to bring the deposits into production.

The law's principal provisions reflected this logic with unusual clarity. Concession rights were granted via a simple per-hectare fee (the derecho de vigencia) rather than through case-by-case ministerial discretion, dramatically reducing administrative friction and the scope for corruption in concession-granting (a Fujimori-era priority, ironic in retrospect given the later Lava Jato findings discussed in PE-J-01). Stability contracts — the convenios de estabilidad jurídica, available to investors above a threshold — locked in the prevailing tax and royalty regime for periods of 10 to 15 years, immunising large investments against subsequent political change. National-treatment rules eliminated the prior discrimination in favour of domestic operators, and majority-foreign ownership was permitted across the sector. The 1993 Constitution (PE-K-01) then constitutionalised the broader framework: Article 66 affirmed state ownership of natural resources but explicitly authorised concession to private parties; Article 63 guaranteed equal treatment for foreign and domestic investment.

The privatisation wave that followed transferred most state mining assets to private hands between 1992 and 1997. Hierro Perú, the iron-ore producer in Marcona, was sold to Shougang Corporation of China in 1992 for approximately US$120 million plus committed investment — a transaction whose terms were widely criticised as undervaluing the asset and whose subsequent labour-relations record at Shougang Hierro Perú became a recurring grievance [TBD-VERIFY: the Shougang sale price and committed-investment figures are variously cited; confirm against ProInversión retrospective documents]. 4. The First-Wave Projects: Yanacocha, Antamina, Cerro Verde (1992–2002)

Minera Yanacocha began production in 1993 in the highlands above the city of Cajamarca, approximately 3,500–4,100 metres above sea level. The operation was a joint venture among Newmont Mining (US, 51.35%), the Buenaventura group of the Benavides family (Peru, 43.65%), and Sumitomo Corporation (Japan, 5%). It was, in its first decade, the most profitable gold mine in Latin America: low-grade ore amenable to large-scale heap-leach cyanide processing, a single open-pit footprint expanding outward into successive concession blocks, and operating costs well below the global average. By the mid-2000s, Yanacocha was producing in the range of 2.5–3 million ounces of gold per year and was the largest single source of foreign-exchange earnings in Peru. The economic centrality of Yanacocha, and its location adjacent to a poor highland comunidad campesina belt and a regional capital with a deep university and civil-society tradition, made it the laboratory in which Peru's mining-conflict politics were first articulated.

The conflict trajectory at Yanacocha began with localised disputes over water in the late 1990s — manantiales (springs) that had served comunidades below the operation began to dry or to discharge differently — and escalated dramatically with the June 2000 Choropampa mercury spill. A Yanacocha contractor truck spilled approximately 151 kilograms of liquid mercury across a 27-kilometre stretch of road through the towns of Choropampa, Magdalena, and San Juan; villagers, unaware of the substance's toxicity, collected it. Antamina's labour and community-relations record has been comparatively better than Yanacocha's: substantial investment in San Marcos and Huarmey municipal development, a more conservative water-management profile, and an avoidance of major expansions that would extend the social-licence problem. But Antamina has had its own conflicts — the 2012 Huarmey derrame (spillage from the pipeline outlet), recurring labour disputes — and the very fact that it has been a comparatively well-managed operation has been used by both supporters (proof that the model can work) and critics (proof that it requires uncommonly favourable conditions) to argue their positions.

Cerro Verde, near Arequipa, expanded through the 1990s under Cyprus Amax's ownership before passing to Freeport-McMoRan in 1999 and then through a series of partial ownership changes that left Freeport as the controlling shareholder, with SMM Cerro Verde Netherlands (Sumitomo) and Buenaventura as minority partners. Its 2007 leaching-plant expansion roughly doubled production; its 2015–2016 concentrator expansion (the "Cerro Verde Phase II", a US$4.6 billion investment) roughly tripled it again, briefly making Cerro Verde the largest single source of Peruvian copper. Cerro Verde's relative conflict-quietness — Arequipa's organised civil society has been more focused on Tía María (Section 8) than on Cerro Verde — reflects partly its longer operating history, partly its location in a region with a stronger industrial base and a more diversified economy than Cajamarca, and partly the absence of an immediate downstream comunidad dependent on the affected watershed.

The first-wave projects taken together demonstrated that the 1991-law framework could attract major investment and bring world-class deposits into production, but they also demonstrated that the framework's silences — on consultation, on environmental contingency, on water rights — would generate political costs that the law itself had not anticipated and could not absorb. The second-wave projects of the supercycle inherited both the proof-of-concept and the unresolved political-economy problem.

5. The Commodity Supercycle and the Second-Wave Projects (2003–2013)

The commodity supercycle's defining feature, from a Peruvian standpoint, was the sustained doubling and re-doubling of copper and gold prices over roughly a decade. Copper rose from approximately US$0.80 per pound at the start of 2003 to a first peak above US$4 per pound in 2008, fell sharply in the post-Lehman crisis to roughly US$1.40 in early 2009, and rose again to a multi-year peak above US$4.50 in early 2011 before settling into a US$3-range plateau through 2013. Gold rose from approximately US$350 per ounce in 2003 to over US$1,900 per ounce in September 2011. The price gains translated directly into Peruvian export earnings: total goods exports rose from approximately US$9 billion in 2003 to a peak of approximately US$46 billion in 2012, with mining and hydrocarbons accounting for the great majority of the increase [TBD-VERIFY: BCRP balance-of-payments series shows total exports peaking near US$46 billion in 2012; confirm exact figure]. Tax revenue from the sector rose correspondingly, and the canon minero transfers to producing regions (Section 13) reached historic peaks.

The second-wave investment pipeline that came into construction during the supercycle was qualitatively different from the first-wave projects. Where Yanacocha, Antamina, and Cerro Verde had been brought online by global majors with long-standing Latin American operations, the second-wave projects involved a more heterogeneous investor pool: Chinese state-linked companies (Chinalco at Toromocho, MMG at Las Bambas, Zijin at Río Blanco), Anglo-Australian majors (Anglo American at Quellaveco), and a continuing role for Glencore-Xstrata in the earlier-permitted projects. The geographic distribution of the second-wave projects shifted southward and into more politically organised highland regions: Apurímac (Las Bambas), Junín (Toromocho), Moquegua (Quellaveco), and the proposed Cusco-Apurímac corridor.

Toromocho, owned by Aluminum Corporation of China (Chinalco), began operations in 2013 in Junín region's Yauli province. Chinalco had acquired the project in 2007 from Peru Copper, a Canadian junior; total investment in construction reached approximately US$3.5 billion. The project's distinctive social-licence feature was the relocation of the entire town of Morococha — approximately 5,000 inhabitants — to a newly constructed Nueva Morococha at lower altitude. The relocation, completed in 2012–2013, became a controversial precedent for megaproyecto community-displacement, criticised by some residents as inadequately compensated and by GRUFIDES and CooperAcción as setting a problematic template for subsequent projects (most directly Las Bambas's Fuerabamba relocation). Toromocho's operational record since 2013 has included recurring environmental-permit disputes — sediment overflows into the Kingsmill tunnel and the Mantaro river system — and a labour-relations record characterised by recurring strikes.

Las Bambas's history merits separate treatment in Section 9, but the supercycle origin must be noted here. Xstrata acquired the Las Bambas project in the early 2000s (built on the Apurímac prospects identified in earlier exploration) and began construction in 2010. The merger of Xstrata into Glencore in 2013, and the antitrust requirements that the merger entailed, forced Glencore to divest Las Bambas. In April 2014, an MMG-led consortium — MMG (62.5%, China Minmetals), Guoxin International Investment (22.5%), and CITIC Metal (15%) — acquired Las Bambas for approximately US$5.85 billion in cash plus assumed obligations, in what was at the time the largest Chinese mining acquisition in Latin America. The transfer from Glencore to MMG occurred without the consent or notification of the affected comunidades in Apurímac and Cusco — a procedural fact that would become an enduring grievance once blockades began in 2015.

Quellaveco, in Moquegua region, was the supercycle's final major Greenfield. Anglo American had held the deposit since the 1990s but had repeatedly deferred construction; the 2012 "Diálogo de Quellaveco" — a regional consultation process led by Moquegua's regional government — was unusual in Peruvian megaproyecto history for the depth of community input it elicited and for the substantial commitments Anglo American made on water use, employment, and regional infrastructure. The eventual Quellaveco construction decision came in 2018, with operations beginning in 2022. Anglo American's partnership with Mitsubishi Corporation (40% interest) helped finance the US$5.5 billion construction cost. Quellaveco is frequently cited — by both Anglo and the Sociedad Nacional de Minería, Petróleo y Energía (SNMPE) — as the model for how megaproyecto development can be conducted in Peru with substantially reduced conflict; critics observe that Moquegua's particular regional-political configuration (a strong regional government, a comparatively organised civil society, a culture of formal-process dialogue) is not easily replicated in Cajamarca, Apurímac, or Puno.

The supercycle thus delivered both the proof that Peru's deposits could be brought into production at supercycle prices and the demonstration that the political-economy infrastructure surrounding extraction had not advanced commensurately. The first-wave conflicts at Yanacocha and Cerro Quilish had been local; the second-wave conflicts — Conga, Tía María, Las Bambas — would become national.

6. The Comunidad-Conflict Cycle: An Analytical Frame

The recurring pattern of mining-community conflict in Peru between roughly 2004 and 2024 has generated a substantial scholarly literature attempting to identify its structural features. Three frames have emerged as analytically dominant, and the corpus treats them as complementary rather than competing.

The first frame, associated above all with Anthony Bebbington's Subterranean Struggles and the broader Latin American Centre at Manchester programme, treats mining conflict as a socio-environmental territorial dispute. The frame's analytical claim is that conflict emerges where mining concessions overlay territories of pre-existing community productive use — pastures, agricultural land, watersheds — and where the mining operation's resource demands (water above all, in highland and altiplano contexts) are perceived as incompatible with those existing uses. The frame predicts conflict intensity as a function of watershed sensitivity, comunidad campesina land-tenure organisation, and the geographic position of the concession relative to downstream agriculture. Conga (a high-altitude project in a critical headwater area) is the paradigmatic case for the Bebbington frame; Tía María (an open-pit project adjacent to an irrigated valley) is the second.

The second frame, developed by Moisés Arce in Resource Extraction and Protest in Peru (2014), treats mining conflict as a political-organisational outcome. Arce's quantitative analysis of protest events across Peruvian provinces from the mid-1990s through the 2010s shows that conflict intensity correlates not primarily with technical or environmental features of the project but with the configuration of local political organisation: the presence of rondas campesinas, the strength of comunidad campesina federations, the political affiliation of the regional government, and the prior protest experience of the locality. The Arce frame predicts that the same project, located in different organisational contexts, will produce dramatically different outcomes — and indeed the contrast between Cajamarca's Conga-Yanacocha record and Moquegua's Quellaveco record fits the prediction. Arce's frame is the most explicitly political and the most useful for understanding why two technically similar projects have produced opposite social-licence outcomes.

The third frame, drawn from Carmen Rosa Balbi's IEP work and the broader Lima-based Argumentos journal tradition, emphasises the vertical-political dimension: mining conflict is, in this reading, partly a proxy for the conflict between an urban, coastal, formal-sector political economy and a highland and Amazonian rural society that has been historically excluded from the núcleo limeño's decision-making. Conflicts at Conga, the Baguazo (Section 10 below), and Las Bambas are read as moments at which the highland and Amazonian periphery makes itself politically visible by interrupting the coastal centre's economic flows. The frame helps explain why mining conflict has had a consistent place in Peruvian electoral politics — Humala in 2011, Castillo in 2021 (PE-D-01) — as a symbol of the wider unrepresented-Andean grievance.

Across all three frames, the conflict cycle exhibits a recurring sequence. Concessions are granted at the national level without community input. Exploration generates initial localised disputes — typically over water, occasionally over land access or over the conduct of company personnel. A flashpoint event — an environmental incident, an arrest, a death — converts diffuse grievance into organised mobilisation. The mobilisation phase produces road blockades, marches on the regional capital, and (frequently) clashes with police. The national government responds, typically with some combination of a gabinete itinerante (cabinet visit to the affected region), a state of emergency, and an ad-hoc negotiation. The negotiation produces either project suspension (Conga, Río Blanco), a partial concession of community demands and continued operation under altered conditions (Quellaveco's "Diálogo" outcome, Las Bambas's recurring road-easement renegotiations), or a continued stalemate (Tía María). The cycle then either ends or recurs with a new flashpoint.

The Defensoría del Pueblo has maintained the most authoritative public record of this cycle since 2004. Its Reporte de Conflictos Sociales — published monthly with cumulative annual indexes — classifies registered conflicts by type, status (latent, active, resolved), region, and actors involved. Socio-environmental conflicts have consistently constituted the largest single category since approximately 2006, with mining as the dominant sub-category. The Defensoría's role as a relatively neutral state institution (autonomous under the 1993 Constitution, headed by an Ombudsman elected by Congress) has given its conflict reporting a credibility that neither MINEM (perceived as pro-investment) nor NGO-based monitors (perceived as anti-mining) can fully achieve. The reports are the indispensable primary source for any quantitative study of the Peruvian conflict cycle.

7. Conga (Cajamarca, 2011–2012)

The Conga project — proposed by Minera Yanacocha as an expansion north and east of its existing Cajamarca operations — became the signal political-economic event of the Humala presidency and the moment at which the supercycle's social ceiling became undeniable. The project entailed approximately US$4.8 billion of investment to develop a gold-copper open-pit operation in the jalca highlands of Celendín and Cajamarca provinces, at elevations of approximately 3,700–4,200 metres. Its distinctive — and ultimately fatal — technical feature was the proposed replacement of four high-altitude lakes (Perol, Mala, Azul, Chica) with engineered reservoirs that would, according to the company's environmental-impact assessment, increase total water-storage capacity in the watershed.

The environmental-impact assessment (EIA) was approved by MINEM in October 2010 under the García administration, on a procedural record that critics argued had been compressed and that GRUFIDES, the Cajamarca regional government, and Cajamarca-based academic specialists (including hydrogeologist Robert Moran in subsequent peer review) contested on technical grounds. The principal substantive dispute concerned whether the engineered reservoirs would adequately replace the hydrological function of the natural lakes — in particular the slow downstream discharge into the bofedales (high-altitude wetlands) and manantiales that supported downstream pastoral and agricultural use. The opposition argued that even if the aggregate water volume was preserved, the temporal and spatial pattern of its discharge would change in ways that the EIA had not adequately modelled, and that the precautionary principle should govern.

When Ollanta Humala (PE-H-PRES-04, PE-B-01) took office in July 2011 — having campaigned on a platform that included defending community rights against extractivist expansion — the Conga decision passed to his administration. Humala initially indicated openness to the regional opposition's concerns and commissioned an international peer review of the EIA, conducted by experts from Portugal and Spain (the Rojas-Sanz-Lossio review, 2012). The review found the EIA technically inadequate in several respects and recommended additional water-management commitments. Yanacocha accepted some of the additional commitments. In the same months, however, the Cajamarca opposition — under regional president Gregorio Santos's leadership and with GRUFIDES's organisational support — escalated to a regional general strike and sustained protest.

The protests reached their peak in late November and early December 2011, then again in July 2012 following the announcement that the project would continue with the additional commitments. In the July 2012 confrontations in Celendín and Bambamarca, five protesters were killed by police gunfire [TBD-VERIFY: the five-death figure is the conventional citation; confirm against Defensoría Informe Defensorial 156 and judicial records]. The deaths produced national outrage, the resignation of cabinet members, and — within months — the operational suspension of Conga construction. Yanacocha placed the project on indefinite hold in 2014 and announced the project's official cancellation in subsequent years; Newmont eventually wrote down its investment.

Conga's significance extends beyond its immediate fact pattern. For the orthodox-success account (PE-G-01 Section 7), Conga represented a project that should have been built — its technical merits were defensible, its scale was significant, and its loss to the Peruvian production pipeline is reckoned in billions of dollars of forgone investment and tax revenue. For the critical account, Conga was the moment Peru's mining sector confronted a community-political ceiling that the 1991-law architecture had no means of accommodating: the regional opposition had legitimate concerns, the EIA process had been inadequate, and the killing of protesters had crossed a moral threshold beyond which continuation became impossible. For the structuralist account, Conga demonstrated that the model's contradictions — between investment-attraction and social-licence — could no longer be resolved by ad-hoc negotiation. After Conga, the megaproyecto pipeline thinned, and no comparably ambitious Greenfield project would be initiated in the Cajamarca region.

The political consequences extended into the 2016 and 2021 election cycles. Marco Arana's Frente Amplio presidential candidacy in 2016 took Conga as a defining issue; Verónika Mendoza's 2021 candidacy similarly. And the Cajamarca electoral pattern — strong support for left-anti-mining candidates — became one of the regional signatures that fed into Pedro Castillo's 2021 victory (PE-D-01).

8. Tía María (Arequipa, 2009–2019)

The Tía María project — proposed by Southern Copper Corporation (Grupo México) in Arequipa region's Islay province — illustrates a different conflict sub-type from Conga. Where Conga's opposition was based in comunidades campesinas of the Cajamarca jalca, Tía María's opposition has been based in the formal agroindustria and small-farmer agriculture of the Tambo valley. The valley is one of the southern-Peruvian coast's most productive agricultural zones, supporting rice, onion, garlic, and potato cultivation under irrigation from the Tambo river. The proposed Tía María open-pit copper operation, planned at approximately US$1.4 billion of investment with a projected production of 120,000 tonnes of copper annually, would be located adjacent to the valley on the pampas above, and the conflict has centred on whether the operation's water demands and atmospheric emissions would damage valley agriculture.

The first major confrontation occurred in April 2011, when sustained protests led by Tambo-valley agrarios and supported by Arequipa's broader regional civil society reached the highway-blockade stage. Police interventions produced three deaths [TBD-VERIFY: Defensoría reporting cites three deaths in the April 2011 confrontations; confirm exact toll], and Southern Copper withdrew the project's first EIA submission. A 2014 resubmission was again contested. A 2015 EIA approval under the Humala administration triggered a second wave of protest that produced further casualties — the most-cited estimate of total Tía María-related deaths between 2011 and 2015 ranges from six to nine, depending on the inclusion of post-confrontation deaths attributed to police actions [TBD-VERIFY: the cumulative casualty figure is variously reported]. Southern Copper again paused construction.

The 2019 episode under President Martín Vizcarra (forward-stub: PE-C-01 Vizcarra presidency) followed the same pattern. In July 2019, MINEM issued the licencia de construcción for the project, triggering a renewed wave of valley-level protests and an indefinite regional strike. Vizcarra's administration, facing a Lava Jato-related constitutional crisis simultaneously (PE-J-01), suspended the construction licence within weeks. As of the 2026 corpus close, Tía María holds a valid construction permit but has not begun construction; Southern Copper has periodically signalled intent to proceed but has not done so.

Tía María is analytically important for two reasons. First, it shows that mining-community conflict is not exclusively a comunidad campesina phenomenon — the Tambo-valley opposition is organised through formal junta de regantes (irrigation boards), gremios agrarios, and municipal governments rather than through rondas campesinas, and its political vocabulary draws on agricultural-property defence rather than on Andean-territorial claims. Second, it shows the limits of the formal EIA-and-licence framework: a project with full regulatory approval has been unable to proceed for nearly two decades because the social-licence problem is unresolved.

9. Las Bambas (Apurímac, 2015–present)

The Las Bambas project differs from Conga and Tía María in a critical respect: it has been built, is operational, and has produced copper concentrate continuously (with interruptions) since 2016. The conflict around Las Bambas is therefore not about whether the project should exist but about the terms of its continued operation — particularly the mineral-transport corridor that connects the mine site in Apurímac's Cotabambas province to the port of Matarani approximately 450 kilometres away.

The original Xstrata project design included a 206-kilometre slurry pipeline that would have eliminated road transport. After the 2014 sale to MMG, the consortium changed the design: the slurry pipeline was replaced by a road-trucking system using approximately 200 trucks per day moving copper concentrate along a route through the Cotabambas, Chumbivilcas, and Espinar provinces — provinces with strong comunidad campesina organisation, prior conflict experience (Espinar had a long-running dispute with Glencore's Tintaya operation), and historical underinvestment in highway infrastructure. The corridor change was authorised through an EIA modification that was approved without consultation with the affected communities along the new route. This procedural fact — the absence of consultation on a transport-corridor change that materially affected dozens of comunidades — has been the foundational grievance of the Las Bambas conflict cycle.

The first major Las Bambas confrontation occurred in September 2015 at Cotabambas, when protests against MMG's operational permits produced four deaths [TBD-VERIFY: the September 2015 Cotabambas casualty figure is conventionally four; confirm against Defensoría reports]. A second wave in 2016 produced further casualties. The road-blockade pattern then became chronic: communities along the corridor — particularly Fuerabamba (the comunidad resettled from the mine site itself, now living in a Nueva Fuerabamba relocation site that has produced its own dissatisfactions) and various Chumbivilcas comunidades — have repeatedly blocked the road for periods ranging from days to weeks, typically demanding renegotiation of compensation, employment, or environmental commitments. MMG has alternated between declarations of fuerza mayor (force majeure) suspending operations and operational continuity under reduced capacity.

The pattern recurred under every Peruvian government from Humala onward. Under Kuczynski (2016–2018), Las Bambas blockades produced state-of-emergency declarations. Under Vizcarra (2018–2020), the conflict continued. Under Castillo (2021–2022), Castillo's government attempted negotiation but achieved only short-term cessations. Under Boluarte (PE-D-04, 2022–2024), blockades coinciding with the 2022–2023 Boluarte-era protests (PE-D-03) — many of which occurred in the same Apurímac and Cusco provinces — produced months of operational interruption. MMG's cumulative production losses from Las Bambas blockades have been variously estimated [TBD-VERIFY: cumulative losses to 2024 are estimated at over US$1 billion in revenue terms in some accounts; confirm against MMG annual reports].

Las Bambas illustrates the limits of even a built and operational megaproyecto in the post-Conga Peruvian context. The project's existence is not contested; its terms of operation are continuously negotiated through the politics of the road blockade. And the consequence for the Chinese-controlled MMG has been to develop direct relationships with Peruvian regional and community interlocutors that bypass — or supplement — the traditional Lima-based industry-government interaction patterns. This is a significant feature of the post-2014 transition described in Section 11.

10. The Baguazo and ILO 169 Implementation: Humala's Consulta Previa Law (2011)

The 5 June 2009 confrontation at the Curva del Diablo near Bagua, Amazonas region, between police and Amazonian indigenous protesters — the Baguazo — was the largest single mining-and-extractives-related lethal event of the entire 1990–2026 period. The immediate trigger was a set of legislative decrees issued by Alan García's second administration (PE-D-01, PE-H-PRES-02) in 2008 to facilitate the implementation of the US-Peru Free Trade Agreement (PE-K-02 context — note: the K-02 referenced here is the prior Internal Armed Conflict doc; the US-FTA decision is PE-K-02 in the country taxonomy's list but appears as a forward-stub for a not-yet-written document on the 2009 USFTA ratification). The decrees would have opened Amazonian indigenous territories to more readily transferable concessions for mining, oil, and timber.

García's defence of the decrees — in his El perro del hortelano essay published in El Comercio in October 2007 — argued that indigenous communities holding extensive Amazonian territories were preventing the productive use of resources that would benefit the broader nation, and that the prevailing legal framework constituted a kind of unproductive incumbency. The essay's title metaphor (the "dog in the manger") was widely read as dismissive of indigenous land rights, and it provoked an organised response from AIDESEP (Asociación Interétnica de Desarrollo de la Selva Peruana) and other Amazonian federations. By 2009, AIDESEP-led mobilisations had occupied infrastructure and blocked highways throughout the Amazon for over two months. The Bagua confrontation on 5 June 2009 produced 33 deaths according to official Peruvian government accounting (23 police officers, 10 civilians) and contested higher figures from AIDESEP and indigenous-rights organisations [TBD-VERIFY: the official 33-death figure is from the Peruvian Congress's investigating commission; AIDESEP and some external accounts cite higher civilian totals, with some figures disputed by the Comisión Especial Investigadora]. The disappearance of officer Felipe Bazán — never recovered — became a separate sub-controversy.

The Baguazo's political consequences were profound. Yehude Simon resigned as prime minister; García withdrew the controversial decrees; the Peruvian government's relationship with Amazonian indigenous federations was substantially damaged. And — crucially for the mining sector — the political opening was created for the eventual legislative implementation of ILO Convention 169, which Peru had ratified in 1994 but never legislatively implemented.

When Humala took office in July 2011, the implementation of ILO 169 was one of his administration's first major legislative priorities. Ley 29785 — the Ley del derecho a la consulta previa a los pueblos indígenas u originarios — was approved by Congress on 23 August 2011 and signed into law on 6 September 2011 in a ceremony deliberately held in Bagua, at the site of the 2009 confrontation. The law established procedures for prior consultation with indigenous peoples on legislative and administrative measures that might affect their collective rights. The implementing regulation (DS 001-2012-MC) was issued in April 2012 under the Ministry of Culture's responsibility.

The law's subsequent implementation, however, has been substantially narrower than its symbolic enactment suggested. Three implementation problems have constrained its effect on the mining sector. First, the base de datos de pueblos indígenas (BDPI) — the official register identifying indigenous communities entitled to consultation — has been constructed conservatively: most highland comunidades campesinas have not been included, on the contested basis that they do not meet the ILO 169 self-identification criteria. AIDESEP's Amazonian federations are included; many Andean federations are not. Second, the medidas administrativas triggering consultation have been interpreted narrowly: most mining-exploration permits and concession grants have been classified as not triggering consultation, on the contested basis that they do not directly affect collective rights at the relevant stage. Third, the consultation procedures themselves have been criticised as procedurally hollow — short timeframes, inadequate translation, limited substantive impact on the eventual administrative decision.

The post-Humala implementation pattern has been substantially uniform across the Kuczynski, Vizcarra, Castillo, and Boluarte administrations. Consulta previa has been used selectively, primarily for forestry and hydrocarbon concessions in clearly Amazonian-indigenous territories, and has had limited reach into the highland megaproyecto sector that generates most of the mining-conflict cycle. The Defensoría del Pueblo's repeated recommendations to expand the law's scope have not been adopted. The 2026 electoral campaign (PE-D-06) has revived debate about whether the law should be reformed to extend consultation to the comunidades campesinas of the Andes — a reform that would substantially alter the post-1991 mining regulatory framework.

11. The Post-2020 China Buyer Architecture

China's transformation from a peripheral participant in the Peruvian mining sector in the 1990s to its dominant buyer and a major operator by the 2020s is one of the structural shifts that defines the corpus's forward horizon. The transformation occurred in three identifiable phases.

The first phase, 1992–2007, was peripheral entry. Shougang Corporation's 1992 acquisition of Hierro Perú was the only major Chinese operational presence in Peruvian mining through the 1990s and early 2000s, and its operational record at the Marcona iron-ore site — labour disputes, technology underinvestment, and environmental complaints — produced little appetite in Lima for further Chinese participation. Chinese demand for Peruvian copper was rising through this period but flowed through existing intermediaries (the global majors, the Glencore-Xstrata trading apparatus).

The second phase, 2007–2014, was Chinese operational entry at scale. Chinalco's 2007 acquisition of the Toromocho project, completed in 2013, established the template: a state-linked Chinese acquirer, a substantial Greenfield investment, and the use of Chinese engineering and construction contractors for project build-out. The Chinalco-Toromocho transaction was followed by Zijin Mining's stake in the Río Blanco project (still undeveloped as of 2026), Aluminum Corporation of China's interest in exploration concessions across Cajamarca and Apurímac, and increasing Chinese participation in trading and processing relationships with existing operators.

The third phase, 2014–2026, was the consolidation of Chinese operational and buyer dominance. The 2014 MMG acquisition of Las Bambas (Section 9) made one Chinese state-linked entity the operator of one of the world's largest copper mines. By the early 2020s, Chinese-controlled operations — Toromocho, Las Bambas, Shougang Hierro Perú — accounted for approximately one-third of Peruvian mineral export value [TBD-VERIFY: Chinese-operator share of Peruvian mineral export value is variously estimated at 30–35% by mid-2020s; confirm against MINEM-SUNAT export data]. China's share of total Peruvian exports (across all sectors but with mining dominant) reached approximately 30% by the early 2020s and has remained the largest single-country share since [TBD-VERIFY: BCRP and SUNAT data show China at ~30%+ of total exports by 2022; confirm exact year-by-year shares].

The November 2024 inauguration of the Cosco-operated Chancay megaport (PE-F-01) consolidates this architecture in physical infrastructure. Chancay's deep-water capacity allows direct loading of large-class bulk carriers — particularly capesize vessels for iron ore and large handymax vessels for copper concentrate — that the existing Pacific ports (Callao, Matarani, Ilo) cannot accommodate at the same scale. The port's operational integration with Cosco's global shipping network produces a direct logistical channel from Peruvian mineral output to Chinese smelter capacity, particularly at the Yangshan-Ningbo industrial complex.

The political-economy implications of this architecture are several. First, the buyer's leverage over Peruvian regulatory and royalty decisions has increased: any Peruvian government contemplating a substantial restructuring of mining taxation or community-relations rules must factor in the response of the dominant buyer and operator. Second, the Chinese operators have proven institutionally different from the Western majors in their community engagement: less media-visible, less likely to engage through the Sociedad Nacional de Minería's collective channels, and more reliant on direct bilateral negotiation with Peruvian central government. Third, and analytically most significant, the configuration creates a degree of Peruvian dependence on Chinese demand that the existing literature (Crabtree-Durand on elite capture; Dargent on technocratic insulation) has not yet adequately theorised. Forward analyses (PE-O-02 as a future stub) will need to develop frameworks for understanding Peru's strategic position within a Pacific copper-supply architecture whose principal actor is the People's Republic.

12. Artisanal and Illegal Mining: Madre de Dios, La Pampa, and REINFO

Parallel to the megaproyecto sector, Peru hosts one of Latin America's largest artisanal-and-small-scale mining sectors. The minería artesanal y de pequeña escala (MAPE), and its substantial illegal sub-sector, constitute a distinct economic-political phenomenon that the Western-focused literature on Peruvian mining political economy has tended to underweight. Three geographic zones dominate: the Madre de Dios goldfields in the southern Amazon; the Pataz-Parcoy belt in La Libertad in the northern Andes; and the Puno altiplano informal-mining zones bordering Bolivia.

Madre de Dios is the emblematic case. The region's southern-Amazon location, the placer-gold geological character (alluvial deposits accessible with relatively simple equipment), and the rising gold price through the 2000s and 2010s produced an explosive expansion of informal and illegal mining beginning in the late 1990s. Estimates of total population involved in MAPE in Madre de Dios range from 30,000 to over 100,000 depending on definitions [TBD-VERIFY: population estimates vary; confirm against INEI and Sociedad Peruana de Derecho Ambiental (SPDA) figures]. The environmental impact has been catastrophic: deforestation of over 100,000 hectares of Amazon by 2020 according to Monitoring of the Andean Amazon Project (MAAP) satellite analysis, mercury contamination of river systems and indigenous communities downstream, and the destruction of the Tambopata national reserve buffer zone.

The February 2019 Operación Mercurio — a major federal intervention under President Vizcarra (forward-stub: PE-C-01) — sought to clear the La Pampa illegal-mining zone, an area of approximately 25,000 hectares within the Tambopata reserve buffer that had been comprehensively deforested by approximately 4,000 informal miners. The operation involved a sustained military and police presence, the destruction of mining equipment, and an attempted permanent state presence (a new base militar at Mega 14). The operation was initially declared a success, but subsequent monitoring showed substantial illegal-mining recovery within 18 months as miners shifted to adjacent areas. Operación Mercurio illustrated both the federal state's capacity to mobilise force against illegal mining and the limits of that capacity when not accompanied by sustained alternative-livelihoods programmes.

The political-institutional architecture for the MAPE sector has centred on the Registro Integral de Formalización Minera (REINFO), established in 2017 under DL 1336 to provide a transitional formalisation pathway for informal miners. Miners registered in REINFO were granted temporary protection from prosecution while pursuing the formal-licensing process. The original sunset date was 2020; it has been extended repeatedly — under Vizcarra, Sagasti, Castillo, and Boluarte — typically under political pressure from MAPE associations including the Confederación Nacional de Mineros Artesanales (CONFEMIN). The 2024–2025 Boluarte extensions (PE-D-04) became flashpoints, with critics arguing that perpetual REINFO extension converted what was meant to be a transitional formalisation programme into a permanent shield for illegal operations.

The MAPE sector's significance has grown in two further dimensions. First, illegal gold has become a significant channel for organised crime and money laundering, with documented links between Madre de Dios mining camps and organised criminal networks operating across the Peru-Bolivia-Brazil triple frontier (the triple frontera). The 2024–2025 security crisis described in PE-D-05 has been partly attributed to illegal-mining-linked organised crime, and Boluarte-era extorsión and sicariato increases in Madre de Dios have been documented by Sociedad Peruana de Derecho Ambiental and Ojo Público. Second, MAPE has become a significant political constituency in its own right: REINFO-registered miners and their associations have been able to mobilise substantial protest action and to extract policy concessions from successive governments. The 2026 electoral campaign (PE-D-06) features MAPE policy as a contested issue.

13. The Canon Minero and Regional Politics

The canon minero — established by Ley 27506 in 2001 and refined through subsequent legislation — is the fiscal-redistribution architecture connecting mining-tax revenue to producing regions. Under the prevailing framework, 50% of mining-derived income tax (the impuesto a la renta paid by mining operators) is transferred to the producing region's subnational governments according to a statutory formula: 20% to the regional government, 50% to provincial and district municipalities of the producing region, 20% to district municipalities specifically of the producing locality, 5% to the producing region's public universities, and 5% to a fondo intergubernamental [TBD-VERIFY: the exact percentage breakdown has been modified several times; confirm against the most recent Ley de Canon and supreme decree updates].

The canon transfers reached their historical peak in the late supercycle period, with regions like Áncash, Cajamarca, Moquegua, and Arequipa receiving annual per-capita transfers far exceeding the national average. The 2007 canon transfers to Áncash region alone reached over one billion soles. The canon was promoted as the mechanism through which mining-region populations would directly benefit from the extractive economy and through which the political legitimacy of the mining sector would be reinforced.

The fiscal-political record of the canon has been mixed. On one hand, canon transfers funded substantial regional infrastructure: roads, schools, health centres, and water-and-sanitation projects across the producing regions. Some of this investment is genuinely transformative. On the other hand, three structural problems have constrained the canon's development impact. First, execution-rate problems: regional and municipal governments have routinely failed to spend their canon allocations within the budget year, producing large accumulated balances and signalling weak local-administrative capacity. Second, corruption: the procurement of canon-funded projects has been a major channel for regional-level corruption. The 2017 conviction of former Áncash regional president César Álvarez — convicted of multiple corruption-and-criminal-organisation offences related to canon procurement and sentenced to extended imprisonment — illustrates the pattern, but is far from unique [TBD-VERIFY: the Álvarez case details and sentencing date should be confirmed against judicial records]. Third, volatility: canon receipts vary directly with mineral prices and operator profitability, producing year-to-year fluctuations that complicate multi-year planning.

The canon's political effect has also been complex. In some regions — Moquegua most clearly — canon transfers have helped build a regional political class with material stakes in mining continuity and with the administrative experience to manage it. In others — Cajamarca most clearly — the canon did not prevent the development of strong anti-mining political mobilisation, and indeed the Conga conflict occurred in a region that had received substantial canon transfers from Yanacocha for over a decade. The simple "buy-off" model of canon-as-political-purchase has not proven empirically robust. What the canon does reliably accomplish is to bind a substantial regional political class to mining continuity; what it fails to accomplish is to convert that binding into broad-based popular legitimacy.

A persistent reform debate centres on canon restructuring. Proposals have included: increasing the canon share retained by the central government to fund inter-regional redistribution; converting the canon from a tax-revenue-share to a regalías (royalty)-based system that would smooth volatility; and creating a sovereign-wealth-fund mechanism (modelled on Chile's stabilisation funds) to invest canon receipts long-term rather than spending them within the budget year. None of these proposals has been politically adopted, and the existing canon architecture has proven highly resistant to change.

14. Forward View: Energy Transition, Lithium Hopes, and the 2026 Electoral Question

The forward horizon for Peruvian mining political economy through the late 2020s and into the 2030s is shaped by three factors whose interaction will determine whether the existing model continues, is reformed, or breaks.

The first factor is the global energy transition's projected copper demand. The decarbonisation of electricity generation (renewable expansion and grid investment), the electrification of transport (EV motors and charging infrastructure), and the expansion of data-centre electricity demand together imply long-term copper demand growth that most projections suggest will outstrip supply through the 2030s. For Peru — second only to Chile in global copper production, with a substantial brownfield expansion pipeline and a still-meaningful Greenfield queue (the deferred Conga and Tía María, the long-stalled Río Blanco, the Cajamarca exploration belt) — the demand projection implies sustained relevance of the extractive sector to the national economy and a continuing flow of investment opportunities. The Quellaveco completion (2022) and the Toquepala expansion are recent examples; further brownfield expansions at Cerro Verde, Antamina, and Las Bambas are in various stages of permitting.

The second factor is the Puno Falchani lithium-uranium deposit and the broader question of Peruvian battery-mineral entry. The Falchani deposit, located in the Macusani volcanic field in Puno region, has been promoted by Plateau Energy Metals (subsequently acquired by American Lithium) as a substantial battery-grade lithium resource. Independent reserve estimates have varied [TBD-VERIFY: NI 43-101 filings cite measured-and-indicated resources in the range of several million tonnes lithium carbonate equivalent; confirm against most recent filings], and the deposit's economic viability depends on flotation-and-processing technology choices that remain in development. As of 2026, the project has not entered construction. The political-institutional dimension is significant: Peru's legal framework treats lithium under the same general mining regime as copper and gold, with no special battery-mineral provisions; debate has emerged over whether Peru should create a separate regulatory architecture for battery minerals (along the lines of Bolivia's Yacimientos de Litio Bolivianos state company or Chile's Comisión Chilena del Litio framework) or whether the existing concession-based model should apply. The 2026 election (PE-D-06) features lithium policy as a contested issue.

The third factor is the contract-renegotiation question. The 1991-law architecture of stability contracts, low royalty rates, and concession-based subsoil tenure has been substantially undisturbed across all administrations from Fujimori through Boluarte. Multiple proposals for substantial reform have been advanced — Castillo's 2021 campaign proposals for renationalisation of strategic deposits, various left-coalition proposals for a new régimen tributario minero with substantially higher rates, and reform-minded centrist proposals for the modernisation of consulta previa — but none has translated into legislative enactment. The 2026 election will produce a new government and a restored bicameral legislature (PE-A-04, PE-D-05); whether the new configuration produces contract reform is the open political question. The institutional inertia is substantial: the constitutional protections of investment (PE-K-01), the stability contracts themselves, the macro-orthodox consensus (PE-G-01), and the dependence of the canon-receiving regional political class on continued mining operation all weigh against substantial change. The pressures for change — community-conflict accumulation, the legitimacy deficit exposed by Castillo's 2021 victory and by the 2022–2023 protests, the rising state-fiscal pressure from security and pension demands — are also substantial.

The Peruvian mining sector enters the second half of the 2020s, accordingly, in a configuration of high external demand, accumulated internal conflict, durable institutional architecture, and uncertain political direction. Whether the existing model continues into the energy transition without substantial reform, undergoes a controlled modernisation, or breaks under a future crisis is the open historical question that this corpus document leaves for forward continuation in PE-O-02 (when written).

15. Conclusion: Engine, Enclave, or Both?

The three competing readings of the Peruvian mining political economy — engine, enclave, and hybrid — survive the detailed evidence assembled in this document, and the corpus's analytical posture remains, as PE-G-01 framed it, to hold all three rather than to adjudicate among them.

The engine reading — that mining has been the principal motor of Peruvian growth, poverty reduction, and infrastructure investment over the past two decades — is supported by the export-share figures, the macro-growth correlations, the canon transfers, the employment in supplier industries (estimated at several hundred thousand workers indirectly engaged with the megaproyecto sector), and the foreign-exchange contribution that has underpinned the BCRP's reserve accumulation and the country's investment-grade credit. The engine reading is the institutional position of the Sociedad Nacional de Minería, Petróleo y Energía, of the Ministry of Energy and Mines, and of the post-Fujimori macroeconomic consensus.

The enclave reading — that mining has constituted a capital-intensive enclave with limited productive linkages, that its benefits have been geographically and socially concentrated, and that its conflict generation has produced a recurring legitimacy deficit — is supported by the Bebbington-Bury-Arce evidence on conflict scaling, the Cajamarca regional poverty record (the region that has hosted Yanacocha for over thirty years remains one of Peru's poorest), the persistent informality of the broader workforce (PE-G-01 Section 9), and the documented inability of the canon architecture to translate fiscal transfer into durable development. The enclave reading is the position of CooperAcción, GRUFIDES, and the broader critical-extractivist scholarly tradition.

The hybrid reading — that both engine and enclave are simultaneously true at different scales of analysis, and that the model's defining feature is its inability to convert genuine macro-aggregate gains into broad-based developmental transformation — is the reading this corpus document is closest to. The evidence does not support either polar reading in pure form. Mining has been a genuine driver of investment, tax revenue, and (in some places, some of the time) regional development. Mining has also been a generator of conflict, of dispossession, and of accumulated political grievance. The unresolved analytical question is not whether one or the other reading is correct but what the institutional and political conditions would be under which the engine effects could be expanded and the enclave effects diminished — a question that the existing post-1991 architecture has not been able to answer.

The forward question — engaged in detail in PE-O-02 when written — is whether the energy transition's copper-demand horizon will provide the resources and the time for a more deliberate institutional restructuring, or whether the same accumulation of community grievance, the same patterns of road blockade and project suspension, and the same persistence of the artisanal-illegal sector will continue to constrain the model's developmental promise. The 2026 election is one moment at which that question will be politically engaged. The arc through to the 2031 election will be the longer test.

The Peruvian case remains, in the comparative-development literature, one of the most studied and most contested. Its trajectory matters not only for Peruvian citizens but for the broader question of whether extractive economies in the global commodity-supplier periphery can be made to serve the development of their host societies. The corpus continues this inquiry across PE-G-01, PE-G-03 (the informality political economy, including the REINFO and informal-mining dimension), PE-O-02 (on the mining-conflict trajectory, when written), and the country-level political documents that engage with mining policy as a continuing electoral and governance issue.
